Autonomy and aptitude of the Guides: each Guide carries out their professional activity autonomously, independently and on their own account. The Guides have no employment, subordination, partnership, legal representation or exclusive alliance relationship with NorteWalk. The Platform merely applies qualitative documentary verification filters on the providers’ local credentials in Tucumán at the time of onboarding, but immediate operational control of the outing on the ground rests exclusively with the professional Guide.
Exclusion of liability for accidents or contingencies: to the maximum extent permitted by the applicable civil law of the Republic of Argentina, NorteWalk, its founders, developers and agents are released from all civil, criminal, contractual or non-contractual liability for any kind of direct or indirect damage, financial or non-financial, bodily injury, traffic accidents, lost luggage, theft of valuables or death occurring in connection with the performance, transport, physical conduct or cancellation of the contracted tourist tours.
Land and public-space scope: the User declares that they know, understand and accept that the activities take place mainly in historic urban centers, natural trails or public spaces exposed to weather variations, uneven terrain and general traffic factors beyond NorteWalk’s control. The User assumes, at their own risk and expense, physical responsibility for their participation in the experiences.
Indemnity and channel for claims: should any conflict, malpractice, dissatisfaction or damage arise on the occasion of the outing, the User undertakes to hold NorteWalk harmless and to direct their actions or formal claims solely to the providing Guide who was in charge of the outing, who acts as the sole final contractor of the service.
